Party wall agreement: step-by-step guide

What is a Party Wall Agreement?

If you’re planning any construction or renovation work that involves shared walls or structures close to your neighbours, you might need to serve a party wall notice. 

​

In a nutshell, you’re seeking confirmation that your neighbour consents to the building work on or near the party wall.

​

This is needed under the Party Wall Act 1996, which aims to  protect both property owners' rights and responsibilities. 
 

 

Step 1: Work with a party wall surveyor

To help you comply with the Party Wall Act, as well as setting up clear lines of communication with your neighbour(s), we recommended working with a knowledgeable party wall surveyor.

To be clear, you’re not required to use a surveyor and you can carry out the process yourself. However, a qualified surveyor will act as an independent third party, helping you navigate the legal requirements and ensuring a smooth process.

You can choose a surveyor that best suits your needs, taking into account their expertise, experience and reputation. 
 

 

Step 2: Deciding the type of party wall notice 

There are three types of party wall notice you may need to serve. You can work out which notice you need through a party wall surveyor, or referring to the gov.uk site. Here’s an overview:

 

  1. Party wall notice: If your planned works could potentially affect the shared wall or structure.
     

  2. Line of junction notice: If you plan to build a new wall on the boundary line. 
     

  3. Adjacent excavation notice: If your excavation work is within a certain distance from  your neighbour's property could potentially impact their foundations. 
     

 

Step 3: Serve the party wall notice 

With the help of your party wall surveyor, you’ll need to prepare the party wall notice. Make sure you include all the relevant details about the proposed works.

You’ll need to serve the notice to your neighbour(s), in compliance with the Party Wall Act's specific requirements, giving them a set time to respond.

Step 4: Your neighbour's response 

When your neighbour receives the party wall notice, they can respond in three ways:


a) Consent: Your neighbour can provide written consent, acknowledging the proposed works and waiving the need for a party wall agreement. 

 

b) Dissent: If your neighbour dissents, indicating concerns or objections, a dispute arises. This requires a surveyor(s) to prepare a party wall agreement. 

 

c) No response: If your neighbour doesn’t respond within the specified timeframe, a deemed dispute occurs. A party wall agreement then becomes necessary.

Step 5: Party Wall Agreement 

If a dispute arises or your neighbour dissents, then your party wall  surveyor will guide you through creating a party wall agreement.

 

This document is legally binding and outlines the rights and responsibilities of both parties when it comes to the proposed  construction work.

The agreement also covers construction details, working hours, access requirements, and the resolution of potential disputes that may arise during construction.

Step 6: Construction starts 

Once the party wall agreement is in place, you can start your planned construction work. It’s key that you stick to the terms outlined in the agreement.

Your party wall surveyor will provide ongoing support, ensuring compliance and addressing any concerns that may come up.
